What does a 'Request and Order to Seize Property' court paper actually mean?
I had a credit card with Chase 5 years ago that got charged off. The credit limit was $500 but with all of these interest and late fees, they say I owe about $2,400 dollars. I had a court appointed officer come to my door with papers that said 'Request and Order to Seize Property' and he was asking where my car was. I do not have a car that is registered in my name so he had no luck doing whatever he was trying to do. Can they really take away my car for this?? He said that he is just gonna turn the papers in. But in a few years they might come back. So, does that mean I should never get a car in my name ever again? How long is this gonna haunt me for? I guess they had a judgement for this and it was filed in 2009. I quit making payments on this card in 2005! What do I do?? Should I call up a lawyer? I want to buy a new car but I am scared of getting it in my name. How do they have the right to take away my car for $2,400???
The credit card company obtained a judgment against you. Probably because you didn't appear in court at the appointed time and place. The give the court order to a marshall. He takes the order and has the right to seize any property that you own. Sell the property in order to satisfy the judgment against you plus all legal fees and seizure fees. The court order will probably be revived every year by the credit card company. and it can last seven years, or until you pay them and get the court order resinded. Or, if you didn't owe the money, then get a lawyer, get the whole magila opened up again, and defend yourself against the credit card company. Only problem is, to do that, the lawyer fees alone will far exceed what the credit card company claims that you owe. And there's no guarantee that you will win. And that's life in the big city.
